Registration of a Design Application without a Substantive Examination

For the furtherance of reducing the examination procedure for a design application, the Korean Design Act introduces the system of a non-substantive examination registration which examines only whether a design application meets formality requirements and whether it is contrary to public order and to accepted principles of morality.

In particular, the non-substantive examination registration is applicable to short-term life-cycle articles. Therefore, some designs for articles such as textiles, bedding, clothing, printed matters, cosmetic containers, stationery and the like may be registered, without a substantive examination, within 2 or 3 months from the filing date of a design application.

An opposition against a registered design via such a non-substantive examination may be lodged within 3 months from the date of publication.
